RETURN POLICY – FRESH AND FUNKY

2. Conditions for Returns

Returned products must meet all of the following conditions:

  • The product is unused, uninstalled, unactivated and undamaged

  • The product is returned in its original packaging

  • All original accessories, manuals, cables, labels and components are included

Products that have been:

  • removed from protective packaging,

  • installed or activated,

  • paired with devices,

  • tested beyond what is necessary to establish the nature of the product,

  • or show any signs of use

are not eligible for return and may be refused.

This policy is compliant with Article 14(2) of Directive 2011/83/EU, which allows merchants to hold consumers liable for diminished value caused by handling beyond what is necessary.

 

3. Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to:

  • Products that are customized or made to order

  • Products that cannot be returned for hygienic or safety reasons once opened

  • Digital products or services once delivery has begun with customer consent

  • Products that are clearly used, damaged, or incomplete

These exclusions are based on Article 16 of Directive 2011/83/EU.

 

4. Return Shipping

Unless the product is defective or incorrect, return shipping costs are the responsibility of the customer.

Fresh and Funky is not responsible for:

  • lost return shipments

  • damaged items during return transit

We strongly recommend using a trackable shipping method.

 

5. Inspection and Approval

All returned items are inspected upon arrival.

If inspection reveals:

  • damage,

  • missing parts,

  • signs of use,

  • or non-compliance with the return conditions,

the return will be rejected and no refund will be issued.

This inspection process complies with EU consumer protection regulations regarding reasonable verification.

 

6. Refunds

If a return is approved:

  • Refunds will be issued using the original payment method

  • Refunds are processed within 14 days after receipt and approval of the return

  • Original shipping costs are refunded only if legally required

This is in accordance with Article 13 of Directive 2011/83/EU.

 

7. Defective or Incorrect Products

If a product arrives defective, damaged, or incorrect, customers are entitled to remedies under:

  • EU Directive (EU) 2019/771 (Sale of Goods)

  • Applicable national consumer laws

Depending on the situation, Fresh and Funky may offer:

  • Replacement

  • Repair

  • Partial refund

  • Full refund (only if no reasonable alternative exists)

Clear photo or video evidence is required to assess the claim.

 

8. Non-EU Customers (Including United States)

For customers outside the EU, including the United States:

  • Returns are handled according to applicable local consumer laws

  • The 14-day withdrawal right may not apply

  • Refunds and returns are evaluated on a case-by-case basis

This policy does not limit any mandatory rights under applicable local law.

 

9. Return Authorization

Returns must not be sent without prior approval.

  • Order number

  • Reason for return

  • Supporting photos or videos (if applicable)
